The verdict is in! Katy Perry’s legal battle over that $15-million Montecito mansion has concluded.
The “Teenage Dream” hitmaker purchased the mansion for herself and fiancé Orlando Bloom in July 2020 from the founder of 1-800-Flowers. But the entrepreneur tried to call off the sale, alleging he was mentally incapacitated at the time of the agreement due to pain pills.
On Wednesday, a Los Angeles County Superior Court judge tentatively ruled that Carl Westcott, 84, had not met his burden of proving he was mentally unfit.
“Wescott presented no persuasive evidence that he lacked capacity to enter into a real estate contract between June 10, 2020, and June 18, 2020, the days during which he negotiated and signed the contract,” the judgment read.
The judge said evidence presented by Wescott’s team was not credible or persuasive. The court actually found significant evidence that demonstrated Wescott was well enough to knowingly sign on the dotted line. The evidence included the testimony of a witness who interacted with Westcott while he negotiated and finalized the contract as well as Westcott’s written communications during the same time frame that the court said showed the entrepreneur to be “coherent, engaged, lucid, and rational.”
Westcott’s medical reports showed that none of his doctors found he lacked capacity to engage in any action before the sales contract or for more than a year afterward. According to the court documents, the contract that Westcott negotiated and signed yielded him a $3.75-million profit. He also had entered into other contracts shortly before and shortly after the real estate agreement with Perry and had not attempted to rescind any of those due to lack of capacity.
“Today’s proposed decision is clear — the judge found that Mr. Westcott could not prove anything other than he was of perfectly sound mind when he engaged in complex negotiations over several weeks with multiple parties to transact a lucrative sale of the property that netted him a substantial profit,” Perry’s attorney, Eric Rowen, said in a statement to People.

“The evidence shows that Mr. Westcott breached the contract for no other reason than he had changed his mind,” said Rowen. “We look forward to wrapping this matter up at the scheduled damage trial phase set for February 13 and 14, if not before.”
Westcott filed a lawsuit against the couple’s business manager, Bernie Gudvi, in August 2020, alleging he was heavily medicated and not of sound mind when he contracted with Perry for the $15-million sale. Shortly after the contract was signed, Westcott and his lawyers alleged that he was unable to properly review the contract because he had been on “several intoxicating pain-killing opiates” at the time.
Westcott said in his lawsuit that he had a six-hour back surgery several days before being presented with the proposed real estate contract and had been prescribed powerful medications that left him “intoxicated” at signing time.
The trial began in late September, and the judge has since bifurcated the case. The “Roar” singer is expected to testify in front of the judge in the countersuit regarding damages.
Westcott’s son, Chart Westcott, told People, “While we do not agree with [the judge’s] ruling and wish he had spelled our father’s name correctly in his ruling, we accept it.” “Katy Perry will now have to testify, in person, on damages and the contradictory claims she has made over lost income for the rental of my father’s home. While this has been a long road, the fight for my father is not over and we will continue to represent him and his legacy of incredible achievements.”

While there are some indications that shares of businesses were traded during the Roman Republic, the first modern IPO is widely considered to have been offered by the Dutch East India Company in the early 1600s. In general, the Dutch are credited with inventing the stock exchange, with shares of the Dutch East India Company being the sole company trading in Amsterdam for many years.
In the U.S., Bank of North America conducted the first American IPO, which likely took place in 1783. A report claims investors hiding cash in carriages evaded British soldiers to buy shares of the first American IPO.
Henry Goldman led investment bank Goldman Sachs’ first IPO — United Cigar Manufacturers Co. — in 1906, pioneering a new way of valuing companies. A challenge for retail companies at the time was that they lacked hard assets, as other big businesses like railroads had at the time. Goldman pushed to value companies based on their income or earnings, which remains a key part of IPO valuations today.
Why Does A Company IPO, or “Go Public”?

Participating in an IPO: 3 Steps to Buying IPO Stock
1. Read the Prospectus
IPOs can be hard to analyze: It’s difficult to learn much about a company going public for the first time. There’s not a lot of information floating around beforehand since when companies are private, they don’t really have to disclose any earnings with the SEC. Before an IPO, you can look at two documents to get information about the company: Form S-1 and the red herring prospectus.
2. Find Brokerage
If you want to purchase shares of a stock in an IPO, you’ll most commonly have to go through a broker. Some firms also let you buy shares at the offering price as opposed to the trading price once the stock is on the public market.
3. Request Shares
Once a brokerage account is set up, you can let your broker know electronically or over the phone how many shares of what stock you’d like to buy and what order type. The broker will execute the trade for you, usually for a fee, although many online brokerages now offer zero commission trading.
Who Can Buy IPO Stock?
Not everyone has the ability to buy shares at the IPO price. When a company wants to go public, they typically hire an underwriter — an investment bank — that structures the IPO and drums up interest among investors. The underwriter acquires shares of the company and sets a price for them based on how much money the company wants to raise and how much demand they think there is for the stock.
The underwriter will likely offer IPO shares to its institutional investors, and it may reserve some for other people close to the company. The company wants these initial shareholders to remain invested for the long-term and tries to avoid allocating to those who may want to sell right after a first-day pop in the share price.
Investment banks go through a relatively complicated process in part to help them avoid some of the risks associated with a company going public for the first time. It’s possible that the IPO could become oversubscribed, e.g when there are more buyers lined up for the stock at the IPO price than there are actual shares.
When Can You Sell IPO Stock?
Shortly after a company’s IPO there may be a period in which its stock price experiences a downturn as a result of the lock-up period ending.
The IPO lock-up period is a restriction placed upon investors who acquired company stock before it went public that keeps them from selling their shares for a certain period of time after the IPO. The lock-up period typically ranges from 90 to 180 days. It’s meant to prevent too many shares in the early days of the IPO from flooding the market and driving prices down.
However, once the period is over, it can be a bit of a free-for-all as early investors cash in on their stocks. It may be worth waiting for this period to pass before buying shares in a newly public company.
Things to Know Before Investing in an IPO
An IPO, by definition, gives the investing public an opportunity to own the stock of a newly public company. However, the SEC warns that IPOs can be risky and speculative investments.
IPO Market Price
To understand why investing in an IPO can be risky, it is helpful to know that the business valuation and offering price have not been determined not by the market forces of supply and demand, as is the case for stocks trading openly in a market exchange.
Instead, the offering price is usually determined by the company and the underwriters who negotiate a price based on an often-competing set of interests of involved parties.
Post-IPO Trading
Purchasing shares in the market immediately following an IPO can also be risky. Underwriters may do what they can to buoy the trading price initially, keeping it from falling too far below the offering price.
Meanwhile, IPO lock-up periods may stop early investors and company executives from cashing out immediately after the offering. The concern to investors is what happens to the price once this support ends.

IPO Due Diligence
Investors with the option to invest in an IPO should do so only after having conducted their due diligence. The SEC states that “being well informed is critical in deciding whether to invest. Therefore, it is important to review the prospectus and ask questions when researching an IPO.”
Investors should receive a copy of the prospectus before their broker confirms the sale. To read the prospectus before then, check with the company’s most recent registration statement on EDGAR, the SEC’s public filing system.

Since the heady days of the dot-com bubble, when many new companies were going public, startups have become more disgruntled with the traditional IPO process. Some of these businesses often complain that the IPO model can be time-consuming and expensive.
Particularly in Silicon Valley, the U.S. startup capital, many companies are taking longer to go public. Hence, the emergence of so many unicorn companies — businesses with valuations of $1 billion or greater.

Direct Listings

The rapper, who’s been spending most of his time in Europe as of late, with paparazzi following him and wife Bianca Censori relentlessly while on tour, has just listed his uber-expensive Malibu pad for sale.
Designed by Pritzker Prize-winner Tadao Ando, the Malibu Road house is one of the lauded Japanese architect’s few projects on American soil — another one being Beyonce and Jay-Z’s $200 million house, also located in Malibu.
When Kanye purchased it, the property was being touted as part beachfront residence, part modernist sculpture, making it a great choice for the artist whose minimalist-yet-daring style choices often grace the front covers of magazines.
But not much is left, as the structure has been altered considerably during Kanye’s ownership.
The Vultures rapper bought the roughly 4,000-square-foot beachfront house just two years ago, in 2021, for a whopping $57.3 million — though it’s worth noting that the property was once listed for $75 million.
Retired Wall Street financier Richard Sachs, best known as the ex-boyfriend of former Full House star Ashley Olson, sold it to the recording artist and Yeezy founder.
Now, Kanye West listed the 4-bedroom, 5-bath Malibu abode for $53,000,000, with Selling Sunset star and Oppenheim Group founder Jason Oppenheim landing the listing.
“I wanted to have a listing with such architectural pedigree,” Oppenheim told PEOPLE, adding that the property’s Malibu Road location is “one of the most desirable areas in the world.”
We don’t know whether that means that the rapper’s house will be featured in the upcoming Season 8 of Selling Sunset, but if you’d like to take a look inside Kanye West’s house in Malibu, Jason already put the pictures up on his Instagram (though it looks like he used the listing photos from the home’s last run on the market):
Ye’s crumbled plans for the property
The Malibu house was no impulse buy.
Kanye West had big plans for his beachfront spread.
First, he said he would work with businessman James Goldstein to make it more like his famous Sheats-Goldstein Residence — another concrete-heavy, modernist abode that bears the signature of lauded architect John Lautner.
Then, according to TMZ, he set out to turn the architectural property into a “bomb shelter from the 1910s,” removing all windows and electricity from the home. Here’s how it looks like now:

In fact, the rapper is even being sued by the former property caretaker and project manager he hired for the remodel.
Tony Saxon, who was reportedly hired in September 2021 as project manager, caretaker, and 24/7 security for the mogul’s Malibu home, is suing West, claiming he’s owed $1 million for the work he did on the property, which included several labor code violations.
“Tony worked as the construction project manager and 24/7 security guard when Kanye was having the home gutted, and Kanye put him through hell, violating numerous labor codes and employment laws in the process,” Saxon’s lawyer, president of West Coast Employment Lawyers Neama Rahmani, said in a statement released after news broke about Kanye selling his house.
“This house was ‘a Picasso on the water’ before Kanye ordered Tony to rip it apart. So, while we’re pleased Kanye may finally have the money to fulfill his obligations to Mr. Saxon, buyer beware.”
Now, what’s left of the Tadao Ando-designed home is a concrete shell exposed to the elements, per Robb Report.
How can Kanye’s house command such a high price in its current state?
If you’re wondering why anyone would consider paying over $50 million for a gutted house, or whether Kanye was completely off-base when setting the price, let us provide some context on how the property was priced.
#1 Location, location, location
We know all too well that location is the name of the game in real estate.
With enough funds, there’s almost nothing you can’t change about a house, except for location and lot size (and even the latter is debatable, as you can always purchase additional lots by convincing neighbors to sell).
But the location is the one fixed component that can command sky-high prices regardless of the state the structure is in.
And Kanye’s house is located on Malibu Road which is, like Jason Oppenheim said, “one of the most desirable areas in the world.”
The entire area is lined with million-dollar houses, often priced well above the $10 million mark. And Malibu in itself is prohibitively expensive, with the median listing price for homes in the area standing at a hefty $6.5 million.
#2 Architectural pedigree
Many million-dollar homes often come with name-bragging rights — and Kanye’s house excels here.
But there’s a whole other level of name-dropping that comes with owning a home envisioned by one of our generation’s leading architects.
Tadao Ando is an award-winning contemporary architect best known for his minimalist concrete structures, which have attracted some of the world’s biggest stars, from Beyonce and Jay-Z — who paid $200 million to buy one of Ando’s Malibu projects, setting a new record for the most expensive home ever bought in Califonia — to West’s ex-wife, Kim Kardashian, who’s currently working with the architect to build a home on an undeveloped plot of land in La Quinta, California.
And Malibu’s architecturally distinct properties often command sky-high listing prices.
For proof, look no further than this $59M Ed Niles-designed house that combines glass, steel and Feng Shui principles or architect Harry Gesner’s former personal home, the $22.5M Sandcastle House in Malibu.
#3 Building costs
Beyond the design element, building the property on the beachfront lot was no easy feat.
Construction required 1,200 tons of concrete, 200 tons of steel reinforcement, and 12 pylons to keep it from sinking into the sand, a feat that undoubtedly required millions of dollars.
#4 Beach access & ocean views
The property has direct access to the beach and offers stunning views of the ocean.
It has three levels with the ensuite guest rooms on the lowest floor, the living room and kitchen on the middle floor, and the master bedroom and rooftop terrace on the topmost floor — all opening up to unobstructed ocean views, a luxury that commands a premium in any market.
Now, it remains to be seen whether Kanye’s listing price is realistic or not, and if his star power coupled with the highly desirable location and the house’s architectural pedigree will attract a buyer willing to pay top dollar for the Malibu pad.
Those of us who are hooked on Selling Sunset already know that Jason Oppenheim isn’t a fan of properties priced over the $50 million mark, so it’s unlikely that he would have taken on the listing if he thought the price was unrealistic.

But for married couples who are splitting up, debt — and who’s responsible for it — can be a very real factor in a divorce settlement. So how is student loan debt divided in divorce?
There isn’t one right answer to this question — it depends on countless factors, often including what state you live in and got married in, and whether you have a prenuptial agreement.
Before we start discussing how divorce impacts your student loans, we want to be clear that nothing in this article should be taken as financial or legal advice. This broad overview of student loan debt responsibility post-divorce doesn’t take your unique circumstances into consideration, which is why we recommend discussing the nitty-gritty details with a financial advisor or attorney.
That being said, let’s look at how divorce might impact student loans in various circumstances.
Addressing Separate Student Loans
When it comes to student loans, divorce can make things complicated. Separate loans are typically a little more straightforward, because if you’re the only name on the loan, you’re likely the only one responsible for repayment.
This is especially likely if the debt is in your name only and you took out the loan before you got married.
When you get a divorce, assets and debts are typically divided in part based on whether or not they are considered to be marital property (and this can vary by state, of course). You are typically responsible for loans taken out in your name before you were married, and likewise for your ex-spouse.
It can get a little bit more complicated if you or your spouse took out a student loan after marriage. These loans may be considered marital property, depending on state laws and the circumstances under which you took out the loans.
When addressing marital property, most states either use community property laws, which implies that property or debt taken on during a marriage is jointly owned, or equitable distribution laws, where the property or debt belongs solely to the spouse who initiated the purchase or debt withdrawal. In states with community property laws, marital assets and debts are split 50-50 between ex-spouses.
Most states have equitable distribution laws, which can make dividing assets or debt a touch more confusing. In these states, each spouse has a claim to an equitable share of marital property, which may not be split 50-50.
Courts have final say over what’s fair and equitable, and to determine that, they may look at a spouse’s earning potential, or the support one spouse provided while the other was in school, such as childcare or even the opportunity costs of putting their own education on hold. Furthermore, if, for example, you or your spouse took out loans that were used to support you both, that could also be a consideration in court.
Approaching Refinanced Loans
Here’s the thing: It’s not possible for a couple to combine their separate student loans into a joint, refinanced loan. However, you can refinance your own loans and have your spouse serve as your cosigner.
When might that happen? If, for example, one member of a couple wants to refinance their loans but doesn’t qualify, their spouse may decide to cosign the refinanced loan in order to help them qualify or secure a better rate.
When couples cosign on their partner’s loans, both spouses are on the hook for the debt. While this may work while a couple is together, it can make things complicated when your ex-spouse is the cosigner of your refinanced loan. Paying Your Part
In cases where debt is considered marital property, divorcing couples on good terms can decide how to divide student loan debt and have a court sign off on it. However, in some cases, ex-spouses may simply not be able to take charge of dividing things up, and the court can decide how the debt will be divided instead.
At this point, you’re losing the power of a combined income to pay off your loans, so you may need to consider strategies to help the newly single you afford your payments.
Refinance Your Student Loans
First, you may benefit from refinancing your loans to potentially secure a better rate or term. A better interest rate and shorter term might help you pay down your debt faster and could reduce the money you spend on interest over the life of the loan.
If you lengthen the term of your loan, you may be able to lower your monthly payments, which can help if your budget is strapped. However, longer terms typically mean you’ll end up paying more over the life of the loan.

It’s no secret that student loan debt in the U.S. is soaring. A quick internet search will return countless headlines noting the rising debt total—now over $1.7 trillion.
In search of a possible remedy, Public Service Loan Forgiveness (PSLF) was created in 2007 when Congress passed the College Cost Reduction and Access Act.
What Is Public Service Loan Forgiveness?
Public Service Loan Forgiveness was developed to encourage graduates with federal student loans to pursue relatively low-paying jobs in public service, like teachers, nurses, or public interest lawyers, by helping them with their student loan debt — which may be higher than what their salary could allow them to repay.
At its core, the idea seems relatively simple. After 10 years of qualifying student loan payments while working in a qualified public service job, the remaining balance on a borrower’s student loans would be forgiven by the government.
But when the first batch of students became eligible for PSLF in 2017, 10 years after the program’s inception, it became clear that the guidelines were a little murkier than originally thought.
Data showed that nearly 99% of applicants were denied loan forgiveness. According to the Department of Education, 70% of the approximately 29,000 applicants that have been processed were denied because they failed to meet program requirements.
So, if you plan to pursue PSLF, it could be worth taking a few minutes to double check the program requirements and make sure you meet them all.
PSLF: The Requirements
In order to be considered for loan forgiveness, there are a few program requirements to meet. You can see all the requirements on the Federal Student Aid website , but here’s our high-level look.
Firstly, the borrower has to work for a qualifying employer — like a government agency or certain types of nonprofits.
They’d also have to work full-time. If they happen to be working a few jobs that all qualify for the program, it’s possible to work a cumulative total of 30 hours a week to meet the full-time employment qualification.
PSLF requires applicants to have a Direct Loan or a Direct Consolidation Loan and the loan cannot be in default. Also, 120 qualifying payments would have to be made on an income-driven repayment plan or the 10-year Standard Repayment Plan.
What Is a Qualifying Payment for Public Service Loan Forgiveness?
While it may seem easy to make qualifying payments for loan forgiveness, the process can be confusing at times and requires attention to detail from the borrower pursuing loan forgiveness.
Part of making PSLF qualifying payments is working for an employer who qualifies for the program. To confirm whether an employer qualifies, borrowers need to fill out the employment certification form. As borrowers work toward loan forgiveness in the program, they should fill out the employment certification form every year and every time they switch jobs.
If you’re considering applying to the program, double check the type of loans you hold and make sure they qualify for the program. To check, you can log into the Federal Student Aid website. For example, federal loans such as Perkins Loans or Family Federal Education Loans (FFEL) don’t qualify for PSLF.
However, if they are consolidated into a Direct Consolidation Loan, they may. Note that when loans are consolidated, any payments made prior to consolidation will not count toward the total of the 120 qualified payments required by the PSLF program.
You’ll also likely want to take a look at the repayment plan. In order to make a qualifying payment, the loan should be enrolled in a qualifying repayment plan, typically one of the income-driven repayment plans.
While the standard 10-year repayment plan does qualify for PSLF, by the time 120 payments have been made, the loan should be repaid, so there likely won’t be a balance left to forgive.

Once program requirements are being met, making qualifying payments requires continued diligence. Qualifying payments must have been made after October 2007, when the program started.
Payments should also be for the “full amount due as shown on your monthly bill” and should be made no later than 15 days after the payment due date. Many loan servicers offer the option to enroll in automatic payments, which could potentially make it easier to pay on-time every month.
Another thing to note is that payments only count toward PSLF if they are “required payments.” This means that any payments made while a borrower has in-school status, during the grace period, or during periods of nonpayment like deferment or forbearance, won’t count as a qualifying payment for the PSLF program.
However, payments that were paused due to COVID-19 will count as though you made those payments.
A borrower will only receive credit for one payment per month. Making payments larger than the monthly minimum or making multiple payments a month doesn’t translate into reaching PSLF faster.
If a borrower pursuing PSLF plans to make an overpayment, it can be worth contacting the loan servicer to confirm the additional payment isn’t being applied to future payments.
A payment will only qualify toward PSLF if there is a payment due, so if a borrower has paid ahead, they may be unable to make a qualifying payment for that month.
For those volunteering with AmeriCorps or the Peace Corps, there are separate rules that make it possible for volunteers to use their Segal Education Award or Peace Corps transition payment toward their student loans.
In certain situations, volunteers in these programs are able to make a lump-sum payment that could count for as many as 12 PSLF qualifying payments.
Student loan qualifying payments don’t need to be made consecutively. For instance, if you had made a series of payments while employed with a qualifying employer, but then switch jobs and no longer work with a qualifying employer, you won’t lose credit for the PSLF qualifying payments you’ve already made.
After making 120 qualifying payments, borrowers can apply for loan forgiveness by filling out an application manually or digitally. After years of hard work, they’ll (hopefully) be able to celebrate the sweet victory of achieving student loan forgiveness.
Buyer Beware: Looking Out for Scams
There are many boxes to check as you pursue loan forgiveness and it can be tricky to navigate the intricacies of the program. But, there is help out there.
The Department of Education offers an online help tool for borrowers pursuing PSLF. It can give borrowers an idea of where they stand and assist them through the process of pursuing PSLF.
An important note, there is no fee associated with filing paperwork for PSLF. If you’ve been contacted by a service that offers to provide assistance for a fee, they’re likely not affiliated with the Department of Education. In a worst case scenario, it could be one of the many scams that prey on confusion and have grown in number as student loan debt increases.

What If You Don’t Qualify for PSLF?
If pursuing loan forgiveness through PSLF isn’t an option for you, you can explore some alternatives to manage your student loans. One option available is student loan refinancing, which could give borrowers the ability to lower their interest rate or shorten their repayment term. Terms will vary based on personal financial situations.

A former mortgage consultant who worked for Wells Fargo and ultimately brought a case against the company in a Southern California court over allegedly being fired for complaining about discriminatory lending practices has settled with the company, according to reporting from Los Angeles-based radio outlet KNX News.
Attorneys for both parties jointly filed papers in the Los Angeles County Superior Court on Sept. 14, explaining a settlement agreement “in principle” was reached. On Nov. 3, plaintiff Stuart Williams’ lawyers requested the case be dismissed “with prejudice,” which restricts it from being refiled.
“We strongly disagree with the claims made in this lawsuit and will vigorously defend against those claims,” a Wells Fargo representative said in a statement, as reported in 2021 by MyNewsLA.
Williams, who worked for Wells Fargo in a Beverly Hills office, said he first expressed his concerns about the alleged practices in January 2020, telling his superiors “he believed that the bank had a policy of favoring some loan originators over others.”
The plaintiff also claimed the alleged practice was a violation of the Uniform Deceptive and Abusive Practices (UDAAP) Act since it adversely impacted customers who patronized consultants with less favored originations.
Williams also claimed that Wells Fargo Home Mortgage management “made it mandatory for mortgage consultants such as himself to refuse loan applications from borrowers who are members of racial minorities, the elderly, the disabled, unmarried women and others protected by the ECOA [and] the FHA,” according to the initial complaint.
The suit also claimed that borrowers were adversely impacted by the alleged policies and that loan applications were illegally refused.
The suit in total alleged “wrongful termination, rescission of contract, intentional and negligent misrepresentation, breach of the implied covenant of good faith and fair dealing and a violation of the state Labor Code,” the reporting said.
Wells Fargo in 2022 pledged $210 million to racial equity after it was criticized for lending practices that resulted in Black borrowers receiving mortgage refinances at much lower rates than other institutions.
A generation-skipping trust (GST) allows people to leave assets to grandchildren or other people at least 37.5 years younger. Passing assets from Generation 1 to Generation 3 avoids paying federal estate taxes twice on assets — once when passing to Generation 2 and again when passing to Generation 3.
Although GSTs may avoid estate tax, they aren’t totally tax-free. Assets passing through a generation-skipping trust may be subject to the generation-skipping transfer tax. This tax rate happens to equal the estate tax rate, which ranges from 18% to 40%
. However, the generation-skipping tax generally only applies to estates over $12.92 million in 2023 or $13.61 million in 2024. That number is set to fall to $5 million after 2025.

Who are GSTs good for?
Generation-skipping trusts are best for higher net worth families that want to minimize taxes on their estate, says Diedre Braverman, managing attorney with Braverman Law Group in Boulder, Colorado. People who don’t have a will or estate plan may end up leaving their heirs with taxes that they could have avoided, she adds.
Pros and cons of GSTs
When considering if a GST works best for you, think of the following.
Advantages
When set up properly, a GST may save money in taxes that Generation 2 may have had to pay had they received the assets first. This allows people to leave assets to grandchildren, nieces, nephews, grandnieces, grandnephews, or a younger spouse without having a lot of it swallowed up by taxes, Braverman says.
Trusts may be able to shield assets from lawsuits, bankruptcy and divorce settlements.
Setting up a GST gets you thinking about your legacy. “It may get you into estate planning in general,” Braverman says, “which is a good thing for everybody.”
Disadvantages
Attorney fees associated with setting up a GST vary greatly across the country and can be hefty.
Money in the trust can only be withdrawn for living expenses. While those amounts can be generous, it still has to have some relationship correlated to the beneficiaries’ standard of living, Braverman says.
Trusts require a trustee, which is an ongoing expense.
The generation that gets skipped may have objections. “Generation 2 can typically get income from the trust, but they don’t have ownership in the trust,” says Brian Hill, a partner at Ball Morse Lowe in Norman, Oklahoma. “They can’t sell the asset and go buy a bigger personal home. Because of that, there could be tension.”
How to set up a GST
Work with an estate planning attorney to set up your GST. Some things to keep in mind:
Go slow. Setting up a GST involves at least three generations of people, so it’s essential to think through the process. “This is in place for a long time,” Hill says.
Talk to various advisors. Speaking with different people helps you think through all the different what-ifs, Hill says. Consider including tax professionals, financial planners and even other family members in your conversations.
Keep your appointment. People tend to cancel their appointments when they don’t have all the answers to questions that a lawyer may have sent them before their first meeting, Braverman says. This is a mistake. Working with a good attorney will help you get the answers you need.
Think about what you want your trust to encourage or discourage. Lawyers can put all kinds of provisions in trusts, Braverman says. Stipulations on substance abuse or GPAs or beneficiaries being self-supporting, for example, can help express the client’s overall intent.
GST mistakes to avoid
People often make two common mistakes, according to Braverman.
Naming family members as trustees. Money creates suspicions, and the trustee has a lot of power, she says. This can build resentment and cause problems.
Not considering who will be trustee if your original trustee passes. Consult with your attorney about who will take over if your original trustee can no longer handle the role. Braverman suggests three options for these successor trustees: Trust departments in large financial institutions, trust companies or professional, private fiduciaries.
